Right of Withdrawal and Returns Policy

Launch X431 EU

1. Legal Basis

Consumers are entitled to the right of withdrawal from a distance contract in accordance with Directive 2011/83/EU and applicable national consumer protection legislation. This right allows the consumer to withdraw from the contract within the statutory period without stating a reason and without any penalty.

This policy applies exclusively to consumers (B2C). Purchases made by legal entities, sole traders, or other business customers (B2B) are excluded unless explicitly agreed otherwise in writing.

2. Withdrawal Period and Exercise of the Right

The consumer has the right to withdraw from the contract within 14 days from the day of receipt of the goods.

To exercise the right of withdrawal, the consumer must inform the seller of their decision by a clear and unambiguous statement (e.g. by email). The withdrawal is considered timely if the notification is sent before the expiry of the 14-day period.

The consumer may use the withdrawal form available on the website, but this is not mandatory.

3. Return of Goods

After submitting the withdrawal notice, the consumer must return the goods without undue delay and no later than 14 days from the date of withdrawal notification.

The goods must be returned:

  • in unchanged quantity,

  • without damage,

  • in a condition suitable for resale,

  • together with original accessories and packaging where applicable.

The consumer is permitted to inspect and test the product only to the extent necessary to establish its nature, characteristics, and functioning.
The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary for such inspection.

4. Refund of Payments

In the event of a valid withdrawal, the seller shall refund all payments received from the consumer, including standard delivery costs, within 14 days from the receipt of the withdrawal notice.

The seller reserves the right to withhold the refund until the returned goods have been received and inspected.

Refunds will be made using the same payment method used for the original transaction, unless expressly agreed otherwise.

5. Return Shipping Costs

Unless expressly stated otherwise, the consumer bears the direct cost of returning the goods.

If the goods were damaged or defective upon delivery, the return shipping costs shall be borne by the seller.

6. Exclusions from the Right of Withdrawal

The right of withdrawal does not apply in the following cases:

  • Goods manufactured or customized according to the consumer’s specifications.

  • Software, digital licenses, subscriptions, or sealed data carriers if the security seal has been broken.

  • Digital content not supplied on a tangible medium where performance has begun with the consumer’s express consent.

  • Goods that deteriorate rapidly or have a limited shelf life.

Important – Diagnostic Devices, Activations and Licenses

The right of withdrawal does not apply to diagnostic tablets, software licenses, subscriptions, or services that have been activated, registered, linked to a user account, vehicle, VIN, or serial number.

Once a diagnostic device or license is activated, the activation cannot be revoked, transferred, or reused, and the product becomes permanently bound to the end user.
As a result, an activated product becomes commercially unusable and cannot be resold or reassigned.

By activating the product, the consumer expressly agrees to the commencement of the digital service and acknowledges the loss of the right of withdrawal in accordance with EU consumer protection law.

7. Defective Products, Warranty and Legal Remedies

The right of withdrawal does not affect the consumer’s statutory rights related to:

  • non-conformity of goods,

  • defects,

  • warranty claims.

In cases where the product is defective or non-functional upon delivery, the consumer may exercise their rights under applicable warranty or consumer protection legislation.

8. Business Customers (B2B)

The right of withdrawal applies only to consumers.

For purchases made by companies, sole traders, workshops, fleet operators, or other professional users, the right of withdrawal is excluded unless explicitly agreed in writing prior to purchase.
